These terms and conditions govern your use of the art from scratch (“afs”) website (the “Website”), operated by art from scratch (“we”, “us”, or “our”). By accessing or using the Website, you agree to be bound by these terms and conditions. If you disagree with any part of these terms and conditions, you may not use the Website.

1. Intellectual Property

The Website and its original content, features, and functionality are owned by afs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on the Website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.

Under this license, you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • Attempt to decompile or reverse engineer any software contained on the Website;

afs Services

These terms and conditions govern the provision of art classes and events (hereinafter referred to as “Services”) by afs to participating adults and children (hereinafter collectively referred to as “the Participants”). By booking or attending any of the Services provided by afs, participants agree to be bound by these terms and conditions.

1. Privacy & Intellectual Property

  • Participants retain the intellectual property ownership of original art works they create while participating in afs classes and events.
  • Imagery, audio, and video of participants and participant’s artworks will not be published on social media or other publication platforms without the explicit permission of the student or the student’s guardian if the student is under the age of 15.
  • Personal and sensitive data collected or learnt about participants will be used only for the purposes of delivering the service, will be stored securely in a protected information system, and will not be disclosed to third parties.
  • Participants may request their stored personal information is updated or deleted at any time.
  • Participants may not record, reproduce, distribute, or use any materials provided during the Services for commercial or personal purposes without the prior written consent of art from scratch.
  • Participants who attend the afs studio may be recorded on CCTV.

2. Carers and Dependents

  • Carers must adhere to any age restrictions specified for each class/event.
  • Carers must remain contactable by phone while their dependent is participating in afs Services.
  • Carers are required to advise of dependent participants medical conditions including allergies at the time of enrolment, and to update afs staff of any significant changes thereafter
  • Carers of dependents who may require emergency medicine (i.e. an Epipen) must ensure the dependent has the medicine with them when attending afs Services.
  • Carers of Dependents who display unmanageable disruptive or unsafe behaviour may be contacted and requested to collect the child early and must attend or arrange for an alternative carer to collect the dependent asap.
  • Dependents who are not collected at the end of class / closing time may be taken to the police station to wait for collection.
  • Dependents left unattended with art from scratch must be collected by an authorised adult.
  • Carers of dependents must advise afs staff if another adult will be collecting the dependent person.

3. Safety & Conduct

  • Participants must not bring common allergens on site including: tree nuts, shellfish, dogs, cats, jack jumpers, and bees.
  • All participants and parents of participants are to report any safety incidents or concerns to afs staff asap.
  • Participants who seem affected by drugs or alcohol while on site may be asked to leave the property and must comply or the police might be called.
  • Participants who behave unsafely or are abusive towards staff and other participants will be asked to leave and must comply or the police may be called.
  • Aggressive and defamatory engagement with afs may result in the poster being banned from interacting with afs online.
  • Serious Incidents of abuse will be noted on customer records and may result in future denial of service. afs reserves the right to deny service.

4. Communications & marketing

  • Adults participating in afs Services will automatically be subscribed to the afs mailing list which will be used to periodically communicate information about upcoming events, changes to services, and promotions.
  • afs will not send communications directly to participating minors.
  • Mailing lists subscribers may opt out of marketing communications at any time using the links on the afs website, the links in afs emails, or by speaking with afs staff.
  • afs may contact participants who have opted out of marketing using their provided contact details (email, phone number, or postal address) only when necessary to provide a requested product or service.

5. Cancellations & Refunds

  • Payments are required in full before participating in an event or class.
  • Payment for term attendance is required in full before the beginning of the term.
  • Term attendance fees are non refundable.
  • One-off event and workshop individual attendance fees are refundable in full when cancelled with more than 48 hours notice.
  • Deposits may be required in advance for bespoke event planning services and will be refundable according to the terms of the event agreement.

6. Liability

afs accepts no liability for any loss, damage, or injury incurred by Participants while attending the Services, except in cases of negligence or willful misconduct by afs.

Participants are responsible for their own belongings and any materials provided by afs during the Services.

7. Amendments

afs reserves the right to amend these terms and conditions at any time. Any amendments will be communicated to Participants via email and posted to the afs website.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Australia.
